General Terms and Conditions of Use


1-     How the site works
The site Navigaia aims to help its users explore travel destinations by presenting them with  video, audio and text information about places to visit and things to do there.  The videos may be provided by Navigaia or a contributor.  Equally, users may post their comments on places they have visited and filmed and can also leave comments about the videos viewed on the site.
 
2-     About contributor's videos and comments
Uploaded videos are limited to 100 MB.  They can be submitted in the following video formats: .avi, .mpg, .mpeg, .mov.  These videos can be accompanied by audio commentary or have no audio commentary.  The contributor authorises PocketVox - the editor of the Navigaia site - to alter the format of the video.
The videos will not automatically appear on-line but will first be viewed by the Navigaia team for approval or rejection .  Navigaia has its own criteria for acceptance and any refusal of a video will not be challenged by the contributor.  In addition to good picture quality, the team attaches much importance to the scenery, local population, the sites, local activities and buildings visited.  Too great a presence of the video maker, their friends or family is therefore of little value.
Furthermore, Navigaia distributes short formats of a few minutes in length and reserves the right to reduce the length of a video if too long.  This authorisation is specifically requested when a video is uploaded by a contributor.  As for comments, Navigaia also reserves the right not to show them if they are not pertinent to the item in question or if their content shocks (considered in breach of the peace or contrary to public standards of behaviour).  Furthermore, Navigaia reserves the right to refuse access to the site to any person who breaks any of the above-mentioned rules.

     Advertising on the site
The principal revenue of the Navigaia site is generated by advertising.  In making their videos available to Navigaia, the contributor recognises Navigaia's right to insert advertising on all pages of the site, including those where the contributor's videos are shown and played.  Furthermore, Navigaia may offer some contributors a percentage of advertising revenues generated on the pages where their videos are played.  Generally this will apply to contributors of professional quality videos in the extended catalogue.  A specific contract is offered to them in this instance.
 
4-     Intellectual Property
This site and its images are the property of the company Pocketvox.  The videos naturally remain the property of the person who posted them.  Furthermore, any person posting a video on the site declares they own its distribution rights or, that they have obtained authorisation from the eligible party.  Pocketvox cannot be held liable for the distribution of a video posted by someone who wrongfully assumed the rights to that video.
While the video is stored on our server and in a non exclusive fashion, without financial remuneration, the contributor authorises Pocketvox to distribute its content worldwide whether this is through other Internet sites, mobile telephones or any other digital media or through any other means and under any type of format, when a link has been created to access the  contributions stored on the PocketVox servers.

5-     Personal Information
In order to use certain functions of the site you will need to open an account and store some personal information.  You can modify this information at any moment in accordance with the French law on Informatique et Liberté of 6 January 1978.  Your data cannot be shared with third parties, except if required by law or by  a judicial authority.
Furthermore, to get to know you better and improve your use of our site, a cookie is stored in your Internet browser.  Only you can reset your browser to refuse these cookies.  They are useful to us to see which pages and destinations are most visited so we can increase our supply of videos on these destinations.
It is understood that the information stored electronically in the Pocketvox system is legally admissible as evidence.  In any litigation or other dispute this information will be considered admissible, valid and opposable between parties and in the same manner and under the same conditions, have the same legal relevance as any written document drawn up, received or retained.
 
6-    Conditions governing the use of content on the Navigaia site and on other sites
If you use the Navigaia video player on you own Internet site you must provide a visible link back to the Navigaia Internet site on all pages displaying the said player.
Furthermore, under no circumstances can you set up a comparable service to that of Navigaia using the players and content available on the Navigaia site without having been duly authorised to do so by PocketVox.  Any infringement of this nature will lead to legal proceedings.
